Headed is made by Brad Bice (“we”, “us”). These Terms of Use (“Terms”) cover your use of the Headed iOS app. By using Headed, you agree to them. If you don’t agree, please don’t use the app.
1. Drive safely — this matters more than anything else here
Headed is a trip-planning and progress-display app. It is not a substitute for paying attention to the road.
- Don’t interact with Headed while driving. Plan your route before you set off, or pull over somewhere safe. Hand the phone to a passenger if you have one.
- Obey traffic laws and road signs. Where anything in Headed disagrees with a road sign, a traffic signal, a road closure, or a police officer, the real world wins. Always.
- Headed does not give turn-by-turn navigation. It shows your whole journey — the route, how far you’ve come, how much is left, and what’s nearby. When you want turn-by-turn directions, it hands off to Apple Maps, which has its own terms and its own instructions to follow.
- Routes, distances, arrival estimates, weather, hazards, and places can be wrong or out of date. They come from mapping and weather data that is itself imperfect, and conditions change faster than data does. Use your own judgment.
- Don’t rely on Headed in an emergency, and don’t rely on it as your only source of safety-critical information such as severe-weather warnings. Use official sources.
You are responsible for operating your vehicle safely and lawfully at all times.
2. Your licence to use Headed
Headed is distributed through the App Store, and your licence to use it is governed by Apple’s standard Licensed Application End User License Agreement, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. These Terms sit alongside that agreement and describe how the app works and what it does and doesn’t promise. Where the two genuinely conflict on licence terms, Apple’s agreement governs.
Apple is not a party to these Terms. Apple has no responsibility for Headed or its content, and no obligation to provide any maintenance or support for it.
Headed is currently free, and has no accounts, no subscriptions, and no in-app purchases.
3. Using Headed reasonably
Please don’t:
- use Headed in any way that breaks the law, or that endangers anyone;
- reverse-engineer, decompile, or attempt to extract the source code of the app, except where law expressly permits it despite this restriction;
- try to break, overload, or interfere with the third-party services Headed depends on, or use Headed as a way to scrape or bulk-download their data;
- remove or obscure attribution that Headed is required to display, such as the Apple Weather mark or the Open Charge Map credit.
4. Third-party data and services
Headed depends on outside services to work, and their data is theirs, not ours:
- Apple — maps, search, routing, and weather, via MapKit, WeatherKit, and Core Location.
- RainViewer — precipitation radar imagery.
- Open Charge Map — EV charging station data, contributed by its community and licensed CC BY 4.0.
These services set their own terms and their own accuracy. We don’t control them, we don’t guarantee their availability, and a feature can stop working if a service changes or goes away. Weather, weather-hazard, and EV charging features are scoped to the United States in this version.
What each service receives, and links to their own privacy policies, are set out in the Privacy Policy.
5. Your data
Headed has no accounts and no server. What it remembers — saved places, recent destinations, preferences, an in-progress trip — stays on your device, and deleting the app deletes all of it. The Privacy Policy is the full account, and forms part of these Terms.
Headed does not back anything up. If you delete the app, lose your device, or reset it, your saved places and history are gone and we cannot recover them.
6. Changes, availability, and beta versions
We may change, suspend, or discontinue Headed or any of its features. We may stop supporting older versions of iOS. If Headed is distributed to you through TestFlight, you are using pre-release software that may be incomplete, may contain defects, and may stop working when the build expires.
7. No warranty
Headed is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that Headed will be uninterrupted, error-free, or accurate, or that defects will be corrected.
Some jurisdictions don’t allow the exclusion of certain warranties, so parts of this section may not apply to you.
8. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of Headed — including anything arising from route, distance, arrival, weather, hazard, or place information being inaccurate, delayed, or unavailable.
To the fullest extent permitted by law, our total liability relating to Headed will not exceed the greater of the amount you paid for the app (currently nothing) or US $50.
Nothing in these Terms limits liability that cannot lawfully be limited — including liability for death or personal injury caused by negligence, or for fraud.
Some jurisdictions don’t allow some of these limitations, so parts of this section may not apply to you.
9. Apple as third-party beneficiary
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. This is a requirement of distributing through the App Store.
10. Governing law
These Terms are governed by the laws of the State of Michigan, United States, without regard to its conflict-of-laws rules, except where the law of your country of residence requires otherwise.
11. Changes to these Terms
If these Terms change, the “Last updated” date above changes with them, and material changes will be reflected here before they take effect. Continuing to use Headed after a change means you accept the updated Terms.
